Democracy works for Endangered Species Act, study finds; Citizen involvement key in protecting and saving threatened species

ScienceDaily (Aug. 16, 2012) ? When it comes to protecting endangered species, the power of the people is key, an analysis of listings under the U.S. Endangered Species Act finds.

The journal Science is publishing the analysis comparing listings of "endangered" and "threatened" species initiated by the U.S. Fish and Wildlife Service, the agency that administers the Endangered Species Act, to those initiated by citizen petition.

"We found that citizens, on average, do a better job of picking species that are threatened than does the Fish and Wildlife Service. That's a really interesting and surprising finding," says co-author Berry Brosi, a biologist and professor of environmental studies at Emory University.

Brosi conducted the analysis with Eric Biber, a University of California, Berkeley School of Law professor who specializes in environmental law.

Controversy has surrounded the Endangered Species Act (ESA) since it became law nearly 40 years ago. A particular flashpoint is the provision that allows citizens to petition the Fish and Wildlife Service (FWS) to list any unprotected species, and use litigation to challenge any FWS listing decision. Critics of this provision say the FWS wastes time and resources processing the stream of citizen requests. Another argument is that many citizen-initiated listings are driven less by concern for a species than by political motives, such as blocking a development project.

The study authors counter that their findings bolster the need to keep the public highly involved.

"There are some 100,000 species of plants and animals in North America, and asking one federal agency to stay on top of that is tough," Biber says. "If there were restrictions on the number of citizen-initiated petitions being reviewed, the government would lose a whole universe of people providing high-quality information about species at risk, and it is likely that many species would be left unprotected."

The researchers built a database of the 913 domestic and freshwater species listed as "threatened" or "endangered" under the ESA from 1986 on. They examined whether citizens or the FWS initiated the petition, whether it was litigated, and whether it conflicted with an economic development project. They also looked at the level of biological threat to each of the species, using FWS threat scores in reports the agency regularly makes to Congress.

The results showed that listings resulting from citizen-initiated petitions are more likely to pose conflicts with development, but those species are also significantly more threatened, on average, than the species in FWS-initiated petitions.

"The overriding message is that citizen involvement really does work in combination with the oversight of the FWS," Brosi says. "It's a two-step system of checks and balances that is important to maintain."

The public brings diffuse and specialized expertise to the table, from devoted nature enthusiasts to scientists who have spent their whole careers studying one particular animal, insect or plant. Public involvement can also help counter the political pressure inherent in large development projects. The FWS, however, is unlikely to approve the listing of a species that is not truly threatened or endangered, so some petitions are filtered out.

"You could compare it to the trend of crowdsourcing that the Internet has spawned," Brosi says. "It's sort of like crowdsourcing what species need to be protected."

Many people associate the success of the ESA with iconic species like the bald eagle and the whooping crane.

"To me," Brosi says, "the greater accomplishment of the act is its protection of organisms that don't get the same amount of attention as a beautiful bird or mammal."

For example, the FWS turned down a petition to list the Mojave Desert population of the Desert Tortoise, Gopherus agassizii, but that decision was reversed. The Desert Tortoise is now in the ESA highest threat category, and populations of the entire species are thought to have declined by more than 90 percent during the past 20 years.

"One of the biggest threats it faces is urban and suburban expansion, which could have made it politically challenging for the FWS," Brosi notes. "And yet, the Desert Tortoise is a keystone species that helps support dozens of other species by creating habitats in its burrows and dispersing seeds."

Old regime loyalists attack Yemen defence ministry

Troops of Yemen's elite Republican Guard, led by the son of ousted president Ali Abdullah Saleh, attacked the defence ministry on Tuesday, leaving five people dead and sparking US expressions of concern.

Two civilians were among the dead. Two civilians were also among the 17 wounded, a military source said.

The assault with heavy machineguns and rocket-propelled grenades came a week after President Abdrabuh Mansur Hadi ordered a restructuring of the armed forces as part of a UN-backed plan to ease power away from veteran strongman Saleh who had ruled in Sanaa since 1978.

Washington called for "restraint" by all sides in the impoverished Arabian Peninsula nation which it sees as a key partner in its "war on terror".

Forces under the command of the ousted president's son Ahmed, who remains a powerful figure in the restive nation, laid siege to the defence ministry headquarters in Sanaa before attacking it with machineguns and rocket-propelled grenades, witnesses told AFP.

Hundreds of Republican Guardsmen blocked the roads leading to the ministry in central Sanaa, the witnesses said.

They said the forces, who had come from the main base of the Republican Guard in Sawad, south of the capital, exchanged fire with police on their way to the ministry.

The United States urged all sides to show restraint and respect reforms by the new president.

"We have been urging restraint on all sides, an immediate end to the violence and respect for President Hadi and the reforms that he is putting in place and the democratic transition," State Department spokeswoman Victoria Nuland told reporters.

The United States has been a key backer of Yemen's post-Arab Spring political transition -- which was brokered by its wealthy Gulf Arab neighbours -- and allowed Saleh to visit the United States to be treated for burns he suffered in an attack on his palace last year.

Washington regards Al-Qaeda's Yemen arm as the jihadists' biggest threat to the West and has stepped up drone attacks in recent months in support of an offensive by the Yemeni army to recapture areas lost to the militants during the upheaval that accompanied Saleh's downfall last year.

Government troops managed to repel the attack by Saleh loyalists, arresting a number of them and besieging others in buildings close to the ministry, witnesses said.

Troops guarding the ministry used armoured vehicles to chase the attackers. They were backed by military police and reinforcements from the army's Fourth Armoured Brigade.

Army reinforcements were deployed around the residence of Hadi, who replaced Saleh in the Gulf-brokered peace deal that ended 13 months of protests against the veteran leader, witnesses said.

Troops were also stationed around the central bank as employees were evacuated.

In a presidential decree last week, Hadi ordered the formation of a "presidential protection" force which will include three brigades from the Republican Guard.

The force will also include a brigade from the First Armoured Division led by General Ali Mohsen al-Ahmar who defected to the anti-Saleh opposition last year, official news agency Saba reported.

Hadi assigned other brigades from the two rival units to the central and southern regions, it added.

Under the terms of the peace agreement, Hadi is tasked with restructuring the military and security apparatus, which had been controlled by officials with close ties to Saleh and accused of corruption.

On July 31, a group of policemen occupied the interior ministry and clashed with other forces in a gunfight that left 15 people dead.

Yemen's Supreme Security Committee blamed the assault on "a group of inciters among the ranks of the police force aiming to undermine security," and the government accused those behind the attack of "seeking to spread chaos in a desperate attempt to undermine the political process in Yemen."

Israel and the West believe Iran is aiming to develop nuclear weapons, a scenario that Israel considers to be a threat to its existence. Recent comments attributed to Israeli leaders have raised speculation that Israel is preparing to attack. Such a strike would almost certainly draw Iranian missile fire toward Israeli population centers.

Avi Dichter, who headed the Shin Bet internal security service a decade ago, replaces Matan Vilnai, a former deputy military chief of staff who has been responsible for civil defense for the past five years. Vilnai stepped down to become Israel's new envoy to China.

Prime Minister Benjamin Netanyahu had considered former generals for the post before offering it to Dichter. Israel's "home front command" was harshly criticized for poor readiness during the country's 2006 war, when the Lebanese Hezbollah fired about 4,000 rockets at Israel. Authorities have been working to improve a nationwide system of air-raid sirens, shelters and other emergency services.

Dichter previously served as minister of internal security after decades in Israel's secretive Shin Bet.

"He is now charged with a very important mission: to continue doing what he has been doing his whole life - contributing to the security of the country," Netanyahu said.

Israeli officials believe the Tel Aviv metropolitan area, Israel's main business and population center, would be a main target of any Iranian attack. A mobile rocket defense system will soon be built just outside Tel Aviv, where Israel's sprawling military headquarters sits in the middle of office towers, museums, night spots and hotels.

Israel has welcomed international sanctions imposed on Iran, but it has refused to rule out military action. In recent weeks its leaders have sent signals that patience is running thin.

Dichter has said Israel should not be the leading country trying to stop Iran from attaining a nuclear weapon. He has also said that sanctions alone will not stop the program.

Tough rhetoric

Despite the tough rhetoric, many suspect Israel's leaders are essentially bluffing in order to compel the world to get serious about the issue. Israeli leaders are aware that an attack on Iran would be difficult logistically, likely provoke a counterstrike, send global oil prices skyrocketing and could potentially lead Iran to also target American troops stationed in the region. U.S. officials have pressured Israel not to attack and give diplomacy more time to work.

The issue has generated unprecedented debate in Israeli society over whether an attack to prevent Iran from going nuclear is warranted. While Netanyahu and Barak are believed to favor military action, a number of top former defense officials oppose it.

A group of prominent Israeli authors released a letter this week urging Netanyahu not to attack Iran without permission from his Cabinet. In the letter, the authors threaten to take legal action if Netanyahu doesn't commit to a vote in his 30-member Cabinet by the end of the week. Among the signatories is acclaimed author Amos Oz.
