Soldier admits shooting man trying to cure hiccups

FORT HOOD, Texas (AP) ? A Fort Hood soldier has pleaded guilty to involuntary manslaughter, saying he shot his friend accidentally while trying to scare away his hiccups.

Fort Hood officials say Spc. Patrick Edward Myers, of Spartanburg, S.C., was sentenced Thursday to 3? years in military prison. He also was busted to private and will receive a bad-conduct discharge.

Myers fatally shot Pfc. Isaac Lawrence Young in September while they were watching a football game at a Killeen apartment. Myers told police he thought the weapon had dummy rounds and was trying to scare his friend so his hiccups would stop.

Young, of Ash Grove, Mo., was 22.

The case was tried in military court on the Central Texas Army post because the victim and suspect were soldiers.

German Proposal For Search Engines To Pay For Displaying ...

Google is sounding a warning klaxon about a proposed law change in Germany which aims to strengthen copyright law for press publishers by requiring search engines and online news aggregators to pay a royalty to display snippets of copyrighted text ? such as the first paragraph of an article displayed within a Google News search. If the ancillary copyright law passes, fines would be imposed for unlicensed use of publishers? snippets.

The draft ancillary copyright law (online here in German) gets its second reading today (German law requires three readings before a law can be passed), and is backed by the majority of the governing coalition ? having being included in the coalition agreement between the Christian Democratic Union and the Free Democratic Party.

Currently displaying text snippets is free and legal in Germany so Google argues that the proposed amendement is a complete legal reversal.?The issue is known as ?Leistungsschutzrecht?f?r Presseverleger? in German, and has also?colloquially been dubbed a ?Google tax?.

Mountain View is of course ideologically opposed to the proposal ? calling it a ?mad law? and arguing that it breaks the ?founding principle? of the Web?s hyperlink-based architecture. From a business perspective the company questions why it should have to pay for helping publishers to acquire readers. ??We are bringing massive traffic to the publishers? websites,? Google Germany spokesman?Dr.?Ralf?Bremer told TechCrunch. ?We cannot see a reason why we should pay them for bringing them the readers.?

Setting aside the inconvenience to its business, Google also argues that?the law will be damaging for web users because it will make it harder for them to find German documents because the context provided through use of snippets will be lost. Why should German publishers be treated differently to other publishers, it says. There?s no question of Google agreeing to pay for the snippets ? you can imagine the company viewing that path as a slippery slope leading to an avalanche of copyright claims falling on its head.

There?s little doubt Google is being directly targeted by the proposed law. It specifically cites search engines as the target entity for the additional publisher ?protection? ? and Google is far and away the dominant search engine in Germany. But Mountain View claims the law is not just going to cause it pain ? but could also apply more broadly to other online companies and startups that make use of text snippets.

The text of the current draft of the law states that the proposed protection ?is only against systematic access to the?publishing performance by the search engine providers? (translated from German via Google Translate)?? and goes on to add that?other web users are not included (?such as Blogger, other industrial companies in the economy,?Associations, law firms and private and voluntary users?). However Google says the wording of the draft law also references ?suppliers of search engines and suppliers of such services, who process content similar to search engines? as falling within its remit ? a vague definition that it says could even apply to social networks.

?The question ? which services are meant by the latter [portion of the draft law's wording] ? is controversially debated. The latest interpretations, we have seen, assume that Twitter, Facebook and the like will also be affected,? said Bremer. He argues that every web service or information-based startup that wants to use publishers? snippets could potentially be affected ? adding that many such companies won?t have ?Google-levels of resources? to ensure they are able to comply.

?As soon as this law comes into place there will have to changes made by every platform working on the web,? he said. ?It?s not just a law about Google? it?s about the entire startup scene that we have in Germany, and especially in Berlin. Because potentially every company that works on the web has to deal with snippets, more or less, in their business.?

?From the day this law comes into place, every company that wants to use these snippets? would have to reach out to publishers and call them individually ? ?hi, can you please allow me to use your snippets and what do I have to pay for that?? And if you understand there are more than 1,200 publishers you can imagine that it is simply not possible,? he added.

Another problem with the draft law, as Google tells it, is that it does not nail down the definition of a snippet ? meaning it would be left to courts to decide whether a snippet means a few sentences, a few words or even just a URL. ?It is not even sure the pure hyperlinks are free because some hyperlinks contain part of the text,? Bremer added.

If the law is passed ? and Bremer concedes it looks likely, thanks to the backing of the governing coalition ??Google says it would have to pull German snippets from search results. Setting aside the ideological position of not being willing to pay for something it believes should be free to use, it argues that the legal risk of displaying snippets when the law is so ambiguous would be too ?fraught?.

According to Bremer Germany?s big publishing houses originally lobbied for the law change. He describes them as politically well connected ? and also points out that it?s an election year in Germany this year, arguing that politicians are more likely to want to cosy up to publishers than counter their wishes. ?Pressure from the publishers is really high to get this law done within the coming months,? he said.

Bremer said today?s second reading ? which will involve input from a panel of eight experts (ostensibly independent but three of whom Google argues ?belong to the publishers? lobby?) and at which Mountain View has not been invited to speak ??could be ?the last change to get this law off the table or to shape it in a way that is not so dangerous today for the web architecture?. Google?s hope, says Bremer, is for the governing coalition to listen to the views of the independent experts and think again.

?The arguments against this law are very strong. The arguments for this law are very weak,? he added.

So what about the arguments for the proposed law? German publisher Axel Springer?? whose publications include the newspapers Die Welt and Bild ? is an active supporter of the proposals. Asked to respond to Google?s arguments against the copyright extension,?Christoph Keese,?Senior Vice President of?Investor Relations and Public Affairs for the company and chair of the joint copyright committee of Germany?s newspaper and magazine association, told TechCrunch that ?Google?s statements are unfair and disproportionate? and ?in no way represent what this law is really about?.

Keese also rebutted criticisms about the potential scope of the law, claiming it will ?have no effect on the right to quote or link?, and that ?citations and links stay free?.

He continued:

It is neither ?mad? nor will it harm users, the internet, open society or information pluralism. To the contrary: This reform brings German copyright law much closer to the US concept where publishers traditionally enjoy strong rights. Over here publishers have no rights on their own to this very date even though music, film, television and performing arts have enjoyed ancillary rights since the mid sixties.

What this reform does is very simple: It establishes on opt-in model for commercial copies of content and parts of content. This will lead to license agreements between publishers and aggregators.

On the specific point about the impact on startups, Keese argued that being as the pricing for licensing the snippets will be ?reasonable? then ?no business model shall be discouraged?,?adding:

We have carefully considered impact on the thriving start-up culture especially in Berlin. There will be no negative effects. To the contrary: New innovative business models will arrive built on legally licensed content. Even before the law comes to effect we observe rising demand by start ups seeking investment and licensing opportunities.

This law will help establish a market for aggregator content which at the moment is non-existent. Google (>90% market share) displays monopolistic behavior by trying to impose its legal view on publishers to protect its margin. While publishers respect Google?s technological and entrepreneurial achievements we are not prepared to give content away for free. Search indexing is more than welcome. But aggregators have gone far beyond that.

The royalty rate that publishers would charge has not been determined yet. On the question of pricing, Keese said: ?Parliament has not decided yet if it wants the right to be exercised through a collecting society or not. Absent this decision it would be premature to speculate about pricing.?

Japan tsunami stress may have brought on seizures: study

(Reuters) - The number of seizure patients in a northern Japanese fishing community devastated by the March 11, 2011 tsunami spiked in the weeks following the disaster, according to a Japanese study.

The study, published in the journal Epilepsia, looked at 440 patient records from Kesennuma City Hospital, in a city that was devastated by the massive tsunami touched off by the 9.0 magnitude earthquake.

Thirteen patients were admitted with seizures in the eight weeks after the disaster, but only one had been admitted in the two months before March 11.

Previous research has linked stressful life-threatening disasters with an increased risk of seizures, but most case reports lacked clinical data with multiple patients.

"We suggest that stress associated with life-threatening situations may enhance seizure generation," wrote lead author Ichiyo Shibahara, a staff neurosurgeon at Sendai Medical Center in northern Japan.

But he added that stress itself is not a universal risk factor for seizures.

"Most of the seizure patients had some sort of neurological disease before the earthquake," he said.

His team examined medical records from patients admitted to the neurosurgery ward in the eight weeks before and after the March 11 disaster and compared them to the same time period each year between 2008 and 2010.

In 2008, there were 11 seizure patients admitted between January 14 and May 15. In 2009, there were seven and in 2010, just four.

Of the 13 admitted after the disaster, 11 had preexisting brain disorders that included epilepsy, head injuries or stroke. All the patients lived independently, and eight took anti-convulsive medication.

Shibahara noted that of the five patients admitted just days after the tsunami, it was "not because of a lack of anticonvulsants, but because of the stress."

One later patient, though, was unable to refill his medication weeks after the devastation.

"This is interesting, but I'm not 100 percent convinced," said William Theodore, senior investigator of the clinical epilepsy section at the National Institute for Neurological Disorders and Stroke in Bethesda, Maryland.

Theodore, who was not involved in the study, told Reuters health that because the number of patients was so small, random variation could explain the surge in seizures. Upset patients may also have forgotten to take, or weren't able to find, anticonvulsant drugs.

There are also various ways that natural disasters might cause seizures, including head trauma, infections from polluted water or a lack of sleep, he added.

But the study did have a practical take home message, he said: "If you already have seizures and you're taking medication, always make sure you have a decent supply just in case some natural disaster occurs."

Boeing probe focuses on battery, 787 deliveries halted

SEATTLE/TAKAMATSU, Japan (Reuters) - U.S. and Japanese aviation safety officials finished an initial investigation of a badly damaged battery from a Boeing Co 787 Dreamliner jet on Friday as Boeing said it was halting deliveries until the battery concerns were resolved.

Boeing said it would continue building the carbon-composite 787, but deliveries were on hold until the U.S. Federal Aviation Administration approved and implemented a plan to ensure the safety of potentially flammable lithium-ion batteries that prompted a widespread grounding of the new airplane this week.

In Washington, the top U.S. transportation official, Ray LaHood, said the 787 would not fly until regulators were "1,000 percent sure" it was safe. A week earlier, LaHood said he would not hesitate to travel on a Dreamliner.

Officials from the Federal Aviation Administration (FAA), U.S. National Transportation Safety Board (NTSB) and Boeing joined Japanese authorities looking into what caused warning lights to go off this week on an All Nippon Airways Co domestic flight, prompting the aircraft to make an emergency landing at Takamatsu airport in western Japan.

The incident prompted regulators in the United States and around the world to ground the 50 Dreamliners in service. [ID:nL1E9CH8CJ] The jet has been flying safely for 15 months, carrying more than 1 million passengers, but it has run into problems in recent weeks, including problems with fuel leaks.

The biggest safety concerns centered on its lithium-ion batteries, which are lighter than conventional batteries, pack more energy and are faster to recharge, but are also potentially flammable.

When the FAA announced the grounding of all six U.S.-operated 787s on Wednesday, the agency said airlines would have to show the batteries were safe and in compliance with its rules. It said both battery failures released flammable chemicals, heat damage and smoke - all of which could damage critical systems on the plane and spark a fire in the electrical compartment.

A Japanese safety official at Takamatsu airport told reporters that excessive electricity may have overheated the battery and caused liquid to spill out. Pictures released by investigators of the battery showed a burnt-out blue metal box with clear signs of liquid seepage.

GS Yuasa Corp, the Japanese firm that makes batteries for the Dreamliner, said it sent three engineers to Takamatsu to help the investigation.

A person at the company, who asked not to be named due to the sensitivity of the issue, said: "Our company's battery has been vilified for now, but it only functions as part of a whole system. So we're trying to find out exactly where there was a problem within the system."

An official with Thales, the French company that makes control systems for the battery, referred all questions to Boeing.

At a news conference, the Japan Transport Safety Board (JTSB) said the charred battery and the systems around it would be sent to Tokyo for more checks. It said there were similarities with an earlier battery fire on a Japan Airlines Co 787 parked at Boston's Logan International Airport.

"This information will go to Boeing and the FAA. They will assess it" before allowing the 787 to fly again in Japan, said Hideyo Kosugi, a JTSB inspector. He said the JTSB aimed to issue a report within a week but the U.S. review might take longer.

LaHood, the U.S. transportation secretary, said Friday he could not predict when the 787 would resume flight.

"So those planes aren't flying now until we really have a chance to examine the batteries ... That seems to be where the problem is," said LaHood, who told a news conference on January 11 he would not hesitate to fly on the plane himself.

When pressed by reporters on Friday about whether he regretted his prior statements, LaHood said, "Last week it was safe." What has changed since then, he said, is the fact that another incident occurred involving the batteries.

Karen Walker, editor of Air Transport World magazine, said La Hood and FAA Administrator Michael Huerta chose to "stand side by side" with Boeing executives and underscore the plane's safety because of its huge importance to the U.S. economy as the first all-new American airliner in two decades.

"However, the joint statements of safety confidence and lack of an (airworthiness directive) until after a second serious incident ... could potentially hurt Huerta and LaHood," she wrote.

Boeing shares fell 0.3 percent to $75.04. Since the recent spate of issues began in early December, the stock is up 1.4 percent, against a gain of 5.4 percent for the S&P 500 over the same period.

Shares in the Kyoto-based battery maker GS Yuasa rose as much as 3.9 percent on Friday, having dropped around 18 percent since the January 7 battery fire in the auxiliary power unit (APU) of the JAL plane at Boston.

The U.S. investigation into that incident is focused on the Japanese-made batteries, with no indication the APU - built by United Technologies Corp's Pratt & Whitney - was involved, said a person familiar with the government probe, who was not authorized to speak publicly.

Mark Rosenker, a former NTSB chairman, said Boeing conducted over 1.3 million hours of testing before deciding the lithium-ion batteries were safe to use on the 787, and the company had to satisfy additional rigorous tests to be granted a "special condition" by the FAA to use the batteries.

"I don't believe there was corner cutting in any way. I believe the FAA has done a good job in its certification process. And Boeing is a very formidable and extremely careful airplane manufacturer. You don't survive in this business by not making safe, efficient and reliable planes," he said.

BIGGEST MARKET

Japan is the biggest market so far for the 787, with ANA and JAL operating 24 of the 290-seat wide-bodied planes, which have a list price of $207 million. Boeing has orders for close to 850 of the planes.

Goldman Sachs estimated the hit to ANA's annual operating profit could be up to $40 million if the grounding of its 17 Dreamliners drags on through March. The plane makes up close to a tenth of ANA's fleet and is crucial to its growth strategy.

ANA cancelled more than 60 domestic and international flights through Monday, affecting more than 10,000 passengers. JAL has cancelled 8 Dreamliner flights on its Tokyo-San Diego route until January 25. Other flights will switch to older planes.

A spokesman for the airline said ANA remained committed to the Dreamliner and would spare no effort to get it back in the air safely.

Australia's Qantas Airways said it cancelled an order for one of 15 Dreamliners earmarked for its budget arm Jetstar. It said the decision to cancel was taken late last year, before the plane's recent problems. Qantas has options to order 50 of the new generation aircraft.

Separately, Japan's transport ministry said a fuel leak on another JAL-operated 787 last week was due to a malfunction in a drive mechanism that controls a valve. It said the British company that makes the valve was investigating. The ministry declined to name the firm.

BAD BATCH?

The use of new battery technology is among the cost-saving features of the 787, which Boeing says burns 20 percent less fuel than rival jetliners using older technology.

Hans Weber, president of TECOP International Ltd, a San Diego-based aviation consulting firm and former FAA adviser, said the incidents could be linked to a bad batch of batteries.

"We have to consider the suppliers were at one time producing a lot of equipment for the 787 and then everything got delayed, so some of the stuff they built has been sitting on the shelf for a while. Some of these might have been produced early in the production process and there may have been some deficiencies in the production process," he said.

The 787, a leap in aircraft design, has been plagued by cost overruns and years of delays, though orders last year helped Boeing overtake rival Airbus as the world's largest manufacturer of passenger jets.

Bolshoi ballet director in acid attack, may lose sight

MOSCOW (Reuters) - A masked attacker threw acid in the face of the artistic director of Russia's prestigious Bolshoi Ballet, endangering his eyesight, in what colleagues said on Friday was the culmination of a two-week campaign of intimidation.

Sergei Filin, a former leading dancer at the Bolshoi who has been in the high-pressure job at the heart of Russian culture for nearly two years, was attacked outside his Moscow apartment building as he returned from an outing on Thursday night.

Such is the prestige of Filin's post in Russian life, and its power inside the theatre, that stunned current and former colleagues suggested the motive could have been envy, rivalry or even competition for roles.

His face covered in bandages with holes for the mouth and eyes, Filin sounded relieved to have survived the attack.

"I was scared, I thought he was going to shoot me, honestly ... and I turned to run but he chased me down," Filin told Russia's REN TV.

"He turned and his face was completely covered, either a scarf or some bandage like a mask, only eyes (to be seen)."

The theatre's director, Anatoly Iksanov, had no doubt the attack was aimed at sowing discord in an institution that has rarely been at peace in a history stretching back to the era of Catherine the Great.

Filin, 42, had reported having his car tyres slashed and his emails hacked in recent weeks, as well as receiving repeated nuisance calls from someone who stayed silent when he answered.

"This two-week campaign has ended tragically and despicably," Iksanov said, adding that the culprit "should be sought among those for whom it was beneficial to compromise the theatre leadership".

WAR FOR ROLES?

Bolshoi spokeswoman Katerina Novikova had been out with Filin at another theatre on Thursday evening and parted with him shortly before the attack.

"We just never thought that the war for roles - not for real estate, not for oil - could reach such a criminal level," she said.

Relatives, dancers and theatre administrators flocked overnight to the hospital where Filin was being treated, and later gathered at the theatre.

Some suggested that making enemies, or at least generating resentment, was a hazard that came with the post.

"This person was doing his job," Bolshoi soloist Anastasia Meskova said, choking back tears. "Of course, it's clear that there may have been people who were dissatisfied, but I can't even imagine what would have been the reason (for the attack)."

Russian media said Filin had suffered third-degree burns and that doctors believed it would take him at least six months to recover. Channel One television said doctors were "trying to save his eyesight".

Filin told Iksanov he believed he had been followed home, and that the attacker had called his name before throwing acid on his face.

"There are very serious burns on his face, in his ears, his forehead, his mouth, and of course there are serious concerns about his eyesight," Iksanov said.

Filin was to be flown to a burns center in Brussels on Friday after an urgent operation, Novikova said.

The Bolshoi, which has both ballet and opera troupes, reopened last February after a six-year renovation to its landmark colonnaded building, close to Red Square in the very center of Moscow.

CULTURAL ICON

As a near-mythical icon of Russian culture, it is a magnet for both locals and foreign tourists, and has seen power struggles among both dancers and directors throughout its more than 200 years of history.

Since the collapse of the Soviet Union in 1991, many of those conflicts, whether driven by egos or artistic convictions, have been played out in public.

In 2003 Iksanov dismissed ballerina Anastasia Volochkova after reportedly saying she was too heavy for male dancers to lift, and in 2011 a senior ballet manager resigned after a scandal over sexually explicit photographs.

After the tightly controlled three-decade tenure of Yuri Grigorovich ended in 1995, the Bolshoi Ballet went through five artistic directors before the appointment in March 2011 of Filin, who joined the Bolshoi's ballet troupe in 1988.

Filin's predecessor Alexei Ratmansky, who is now an artist in residence at the American Ballet Theater, said the attack was "no coincidence".

In a Facebook posting, he called the Bolshoi a "revolting sewer" plagued by hangers-on, ticket scalpers and "half-crazed fans ready to chew through the throats of their idols' rivals".

He used the familiar version of Filin's name to end his posting with the words: "Seryozha - the swiftest recovery, and courage!"

Filin's mother, Natalya, said he had been threatened but that she did not know who could have been behind the attack, according to the RIA news agency.

"What's important to me now is the health of my son, that he does not lose his eyesight," she said.

Joy Womack, an American dancer at the Bolshoi, urged "friends, fans and family" on Facebook to "stop what you are doing and pray for Sergei".

"He was attacked by evil people," she wrote. "Pray that the attackers would be apprehended and dealt with in the severity of the law."

First of all we would like to thank all RFOTR members who responded to the Charity Commission on the Draft Scheme for the Rec. Almost 1000 RFOTR members told us that they responded, and we believe that this represents a high percentage of all responses to the Charity Commission. We are eagerly awaiting the final decision of the Charity Commission!

In the meantime a dubious delaying tactic from those opposed to development on the Rec has emerged. An application has been submitted to have the Rec designated as a ?Town or Village Green?. There is a report about this on the Bath Chronicle website. Councillor David Dixon (Chairman of the Bath Recreation Ground Trust) is quoted as saying ?This is merely a stalling tactic, an application which in my view fails on many accounts as a town village green, not least there is a leisure centre in existence and people, are not free to access the land, as all sports and activities are to be booked and paid for through the Trust.

?Mr Sparrow and his colleagues simply do not want the Trust to resolve the outstanding issues, do not want more land brought under the Trust's management in order for it to meet its objectives of making space available for sports, recreation and events.

?How much longer they want the issues the Trust face to go unresolved, who knows? This is now in its 11th year and this is the year to resolve issues one way or another."

Our understanding is that this application fails the criteria of ?the land having been used and continuing to be used as of right by the inhabitants of the City of Bath for at least 20 years for lawful sports and pastimes? for multiple reasons including:
All sporting activities on the Rec (formal or informal) need the permission of the Rec Trust and have to be booked through the Trust
The Leisure Centre (which is included in the application) clearly does not have free access and is not open at all times.
The tennis courts and other facilities on the Rec do not have open access for ?sports and pastimes?
On rugby match days there is not free access to the pitch and stands for ?sports and pastimes?.
In the unlikely event that the application to make the Rec a ?Town/Village Green? becomes successful, this would have a number of consequences. Scientists are reporting development of the first practical way to make large amounts of a promising new anti-cancer substance that kills cancer cells differently than existing medicines. Their article on synthesis of the substance, and tests demonstrating its effectiveness in the laboratory, appears in ACS' Journal of Medicinal Chemistry.

Isamu Shiina and colleagues explain that the substance, AMF-26, showed promise against certain forms of cancer in laboratory studies, fostering excitement about its potential for development as a new anti-cancer drug. That excitement centered on AMF-26's action in targeting a structure in cells, the Golgi apparatus, that had never been exploited in the past. The Golgi apparatus sorts and modifies hormones, enzymes and other key proteins for transport elsewhere.

However, AMF-26 had been available in only small amounts by semisynthesis starting from AMF-14, which was extracted from the common soil mold of the genus Trichoderma.

Their report describes the first successful practical synthesis of AMF-26 and laboratory tests showing that the synthetic AMF-26 is just as effective as its natural counterpart. "The large-scale production of AMF-26 and its derivatives for the development of novel anticancer drugs are now in progress in this laboratory," the report states.

Freedom to Teach: ASE 2013 - Speed Dating for scientists

For years now, one of the biggest events each year in my diary is the ASE Annual Meeting.? This might make me a sad person in some people?s eyes but it?s got to the stage where I should admit it.? I love it.? For three days (four, counting the International Day) thousands of people meet to talk about science education.? These are not only some of the most knowledgeable people but some of the nicest ? and the most positive.? Go to a workshop and ask a question: the chances are you?ll get a range of solutions.? The prospectus has dozens of sessions running at any one time; in fact, the biggest headache is choosing which to attend.

It?s always the first weekend in the year (unless it would clash with New Year), which means the planning has to be done?the year before.? Now that takes some discipline for someone such as me.? This year Collins sponsored a set of workshops I ran, which meant that those of you who came went away with Collins pens, Collins memory sticks and the must-have accessory of the conference, the Collins conference bag. Some people even came to several - evidently the bags were a strong draw. A couple of the sessions had a focus on developing literacy skills (one of them on the six mark questions) and a couple on revision strategies.? Participants in one of these found themselves in an activity called ?speed dating?, in which topic revision is done by asking your ?dating partners? scientific questions.? Fantastic tweet the following Monday from @MrsDrSarah, who?d tried it out with Y11 students ?who liked it a lot?. Biggest turn out though was for the sessions on using iPads in science lessons.? Now, this is an idea whose time has come and I?ll return to it in future blog entries.? One of the things that prompted a significant number of questions though was the stand I used.? Rather like a miniature lectern, it holds the iPad above the table and at an angle.? Apart from being convenient, it also means the camera can easily be used as a visualiser.? Any smallish piece of equipment or student?s work is projected for all to see (the iPad will connect to a projector using a VGA-Apple dock lead).? The image can also, of course, be recorded (or videoed in the case of an experiment) for future reference. If you couldn?t make it to the Annual Meeting, you missed a treat.? Strasser jailed for bribery in European parliament sting

VIENNA (Reuters) - Former Austrian Interior Minister and European lawmaker Ernst Strasser was sentenced to four years in jail for bribery on Monday in a case that prosecutors said undermined trust in European and Austrian institutions.

Strasser had faced up to 10 years in prison after being caught on camera offering to propose amendments to European legislation in exchange for 100,000 euros ($133,500) a year.

"There have been few people in the ... republic who have damaged Austria's image as much as you have," Judge Georg Olschak told a stony-faced Strasser, 56.

"That is why it was necessary to impose a penalty that would have a deterrent impact on possible copycats, and there are likely a few of those."

Strasser's attorney said he would lodge an appeal.

Strasser was exposed by undercover journalists from Britain's Sunday Times posing as lobbyists during a sting operation that ran from mid-2010 to March 2011.

Austria's top law enforcement official from 2000 to 2004, Strasser resigned when the story broke while denying wrongdoing. He said he wanted to protect the Austrian conservative People's Party, of which he was a senior member.

He insisted during his trial that he went along with the "lobbyists" because he believed they were U.S. Secret Service agents and he wanted to find out what they were after.

Olschak dismissed that line as one of the most outlandish he had heard in his two-decade career.

The two British journalists who broke the story in 2011 - Claire Newell and Jonathan Calvert - testified on Monday via video conference, the screen placed so that only court officials - not spectators - could see the undercover reporters' faces.

Calvert told the court the reporters had approached dozens of European Parliament members to sound them out about prospects for amending legislation in return for money, and met around 14.

But it was Strasser, who was an MEP from 2009 to 2011, who made headlines in the sting.

LOBBYIST? OF COURSE

The duo had asked Strasser to amend for clients draft European laws on handling electronic scrap and on regulating investments. They were told it was too late to alter the first, but said Strasser took credit for getting the second changed.

"He came back and said he had achieved an ever better result than we had asked for," Calvert said.

Strasser followed the proceedings calmly, occasionally jotting in a notebook he held in his lap.

"Of course I am a lobbyist," Strasser had told the journalists in a secretly filmed video that has been published on YouTube (http://r.reuters.com/gyd34t).

"This is a wonderful opportunity to learn all the people, to have my own network, and to use this network for my, for my companies. It's a very good combination."

Prosecutor Alexandra Maruna, who had kicked off the trial by saying Strasser "massively harmed European politics", echoed his filmed comments in her final summation.

"'Of course I'm a lobbyist,' Strasser said," she noted, turning to him in the dock. "No you weren't. You were a member of parliament."

Strasser is one of several once-mighty Austrian politicians brought down by corruption scandals that triggered tighter laws last year on party funding and politicians' finances.

Witnesses testified that Strasser was obsessed with the idea he was being spied on, but prosecutors repeatedly questioned why he had not gone to the authorities with his fears.

European politicians have battled to keep faith with the post-war ideals of European integration and rejection of extreme nationalism that led to the founding of what would become the European Union more than 60 years ago.

Less than 50 percent of the EU's half a billion citizens voted in the last European Parliament elections in 2009, and a poll in 2011 found that 26 percent had a negative image of the parliament, up from 17 percent three years earlier.

Defense lawyer Thomas Kralik had argued that what his client did may have been morally reprehensible but was not illegal. "The optics are not too nice, but this is a criminal trial. You are not here to judge optics," he told the judge and jury.

Three other European lawmakers were caught in the Sunday Times sting operation - Romania's Adrian Severin, Slovenia's Zoran Thaler and Spain's Pablo Zalba Bidegain. Thaler resigned after the scandal but the other two still sit in parliament.

However, realising this is crucial because you have to first maintain a positive mental attitude and use the same positive attitude to do a job search.

1. Remember to feel good about yourself.

2. Talk positively about yourself and your abilities.

3. Take charge!

5. Stop worrying about the future.

8. Get physical!

Turn your cool and professional swagger on. While nobody expects you to wear a suit and tie every day on your job search, try not to dress too casually. Keep your work space and living space neat and tidy. Set a positive framework for your job search.

11. Take a team approach to finding a job.

Even if the team is only two people, it is helpful to have somebody else to share ideas with and to review your progress on a regular basis. Talk to your former colleagues and share tips. Talk about what success will look like and how to get there. Go for a drink and discuss in a happy environment.

12. Accept your cycles.

While it is important to maintain a positive attitude, it?s unrealistic to think that you will be 100% positive forever. The trick is not to get down on yourself when you get down. Set a time limit on how long (15 minutes, for example) you will allow yourself to stay down when you feel a little depressed.

13. Join a professional group.

If you are looking for a job in a certain profession, join LinkedIn, Twitter and Facebook. ?Follow? the company, ?friend? them and ?like? their products. Comment on their recent developments and follow their news. However, be professional at all times. Joining an association can be an excellent way to keep up to date on developments and trends. It will help you develop your network and put you in contact with people that have interests similar to yours.

14. Keep growing.

Continue to develop your skills and knowledge while looking for work. Do this by:

  • Taking a class.
  • Attending free webinars
  • Taking part in Twitter (professional) chats
  • Attending conferences, workshops and seminars.
  • Reading pertinent articles on the web
  • Creating a blog of your own
  • Subscribing to RSS feeds
  • Subscribing to trade magazines.
  • Reading the newspaper and other current-affair magazines.
  • Doing volunteer work that uses the skills and knowledge you want to use in your next job.

If you are not immediately successful in finding work, you might start to question your skills and qualifications. Keeping on top of the skills, knowledge and trends in your field will make you feel positive about your ability to do the type of work you want to do.

15. Don?t take rejections personally.

Very few people land the very first job they apply to or are interviewed for. Your attitude really depends on how you look at things. You can see a job rejection as a personal attack on your abilities or character, or you can see it as an opportunity to grow and learn more about yourself.

16. Do it now, don?t delay.

Procrastination is a sure way to lower your self-esteem. Nobody actually considers putting things off as a positive trait, do they? The more you delay, the more depressed you will be when you realize all the things you have left to do. On the other hand, doing something every day will make you feel like you are putting in a real effort and you will feel good about yourself.

17. Attitude is contagious.

Surround yourself with supportive, positive people. Walk away from naysayers, or emotional vampires. Don?t let them drain you of your positive energy.

18. Reward yourself.

Make sure you take time out to relax after a day of job hunting:

  • Go to a movie with a friend or watch a movie at home.
  • Have your?favorite?snack at hand.
  • Read a book.
  • Take a walk.
  • Do anything else that you find enjoyable and relaxing and that will take your mind off job hunting.
  • Chat on your phone
  • Spend time with a loved one

19. Talk to someone.

You might feel really burned out, angry or frustrated after a long, unsuccessful job search. Or you might reach a stage where you want to give up looking for work altogether. At this point it might be a good idea to talk to a trained professional, such as a the Citizens Advice Bureau, a psychologist or a?counselor?that can help you sort out your feelings.

20. Keep a smile on your face.

You might feel like there is nothing to smile about at times but make an effort to keep a smile on your face. Life is good because you are still alive and kicking. You can walk about and look for jobs, you are not defined by your current situation. It is just a phase that will surely pass. No one can get you down except yourself. Cheer up and love life!

Police dig for more remains in Florida missing-baby case

The Hallandale Beach parents arrested in the disappearance of their baby boy -- and labeled by authorities as suspects in the boy?s possible death -- will be required to post higher bond amounts before they are freed from jail, a judge ruled Saturday.

Broward Circuit Judge Geoffrey Cohen raised the bond amounts for Calvin Melvin Jr., 27, and Brittney Sierra, 21, during a weekend court hearing on child neglect charges in the disappearance of Dontrell Melvin, who police say was 5 months old when he was last seen around July 2011.

On Saturday, police and forensic anthropologists kept digging for more remains at the property where Melvin and Sierra once lived. Hallandale Beach police on Friday found remains there that they said were consistent with those of an infant. Police said they haven?t determined whether the remains are Dontrell?s.

As police investigated outside the property, a current resident who moved into the home about six months ago said she was allowed to stay inside her residence. Natalie Garrido, 21, described a hectic day Saturday, saying that many police cars remained parked outside.

Saturday afternoon, she said she saw officials setting up additional tents in the backyard and using buckets as they excavated.

"They?re doing a lot of digging back there, for any leftover bones or something,"?Garrido said. "They added a couple of tents, I guess to protect everything that?s going on."

In court Saturday, the judge first spoke to Sierra, charged with one count of child neglect.

?The allegations are extremely serious,? the judge told Sierra. ?In light of that, I do find it essential to set a very substantial bond to assure her presence at further proceedings.??

Cohen raised Sierra's bond amount to $100,000.

Defense objects to higher bond
Assistant Public Defender Terry Conover, who represented Sierra on Saturday, said he opposed the increased bond amount, given it was basically unaffordable for Sierra.

?Judge, we object to the amount of the bond being tantamount to no bond,? Conover said. ?She has ties to the community. She doesn?t have the funds, and she has really virtually no record, so we object.?

Cohen replied, ?Your objection is noted,? but he didn?t change his mind on Sierra?s bond being $100,000.

Dontrell?s two siblings recently were placed in the custody of the state Department of Children and Families. Sierra told the judge she visited the courthouse Thursday and was told she could "have supervision with my kids."?

"I was wondering can I also see them while I?m here, or when I get out while I?m on house arrest?"?she asked.?

The judge told her he would not authorize her request.

Then the judge addressed Melvin, charged with child neglect and obstructing a criminal investigation by providing false statements to police. The judge increased Melvin's bond to $150,000.

If either Sierra or Melvin were to post their bond amount, each would be freed from jail and placed on house arrest, the judge said.

Each also would be required to wear an electronic monitoring device as they await their court cases to proceed, the judge said.

If Sierra does leave jail, she will stay with her mother in Hallandale Beach, the judge said.

Sierra?s mother, who attended the hearing, told Cohen, ?She has a place to go. She has family that loves her.? The mother declined to comment after the hearing.

Each parent blames the other, police say
Dontrell?s disappearance didn?t become known to authorities until Wednesday, when a child welfare investigator spoke to Sierra regarding a child neglect case, according to Hallandale Beach police.

The investigator determined that Dontrell was missing. She spoke to his grandparents, who said they hadn?t seen the boy in more than a year. The investigator notified police.

After hours of police questioning Thursday, the parents blamed each other in the boy?s disappearance, and each provided police an area to search, police said.

Police said Friday that they dug up the remains in the backyard of a home in the 100 block of Northwest First Avenue in Hallandale Beach. It is reportedly where the couple had lived.

Before the remains were found, Police Chief Dwayne Flournoy said that if evidence warranted further charges, the parents ?will be charged accordingly.?

After the remains were unearthed, the chief said the missing-person case had turned into a homicide investigation. He said, ?Are the parents suspects? Yes.?

National Hockey League Players Gear Up to Vote for new CBA -NHL Update

After the National Hockey League (NHL) Board of Governors ratified the new Collective Bargaining Agreement on Wednesday, it is now the turn of the players to come together and vote in order to approve it from their side and officially bring the lockout to an end.

With over four months gone now ever since the previous labour deal came to an end on September 15, 2012, electronic voting will begin at 8 p.m. Thursday and will go all the way up until Saturday, giving the players more than enough time to approve or reject it.

If the voting process goes smoothly and a majority of the players decide to approve the deal, sources claim that training camps will kick off as soon as this upcoming Sunday and a 48-game regular season will begin from the previously reported date of January 19th.

It was after the 113th day of the lockout that the NHL and Players? Association agreed on mutual terms and conditions after meeting for 16 straight hours. The new deal is set for the next 10 years and will not allow any side to opt out of it before the completion of the eighth year. The previous bargaining agreement had been effect for seven years and brought around another lockout, but not in full, and resulted in just half of the season being locked out.

Due to the lockout, fans missed out on a chance to see the much forward looked to event such as the 2013 NHL Winter Classic and All-Star Game. According to the NHL, they will release an official schedule of the games, once the ratification process is completed entirely.

It is currently a busy time around the NHL as players are making a comeback from foreign leagues, others are being contacted about the return process and some are now looking to sign on to teams as they remain free agents and were unable to sign prior to the lockout coming into effect.

Updates should be expected on the issue in the next 24-48 hours as both sides continue working to get a hockey season back on track.
